DISCLAIMER

Disclaimer

ForeverVault is not a law firm and does not give legal advice or refer clients. The legal text below is in English.

Last Updated: October 22, 2026

This Disclaimer ("Disclaimer") is issued by ForeverVault LLC, an Arizona limited liability company ("ForeverVault," "we," "our," or "us"). By accessing or using the ForeverVault website, platform, or services (collectively, the "Service"), you acknowledge and agree to the terms of this Disclaimer. If you do not agree, you must discontinue use of the Service.

1. NO LEGAL, FINANCIAL, TAX, OR PROFESSIONAL ADVICE

The Service, including all documentation, examples, templates, legacy tools, and informational materials, is provided for general informational purposes only.

ForeverVault is not a law firm, does not give legal advice, and does not refer clients.

ForeverVault does not provide:

legal advice

financial advice

tax advice

estate-planning advice

probate guidance

fiduciary recommendations

investment or securities advice

accounting or recordkeeping services

You must consult with a qualified professional for advice tailored to your specific situation.

Nothing in the Service creates an attorney-client, fiduciary, or professional relationship of any kind.

2. ENCRYPTION AND USER RESPONSIBILITY

Documents added through the website and Android app are encrypted on the user's device before upload. Documents added through the iPhone app are protected in transit and encrypted by ForeverVault before storage. User Content remains encrypted while stored. ForeverVault receives a password through an encrypted connection for verification and stores a hash rather than the plaintext password.

ForeverVault also holds a recovery key so you can reset a forgotten password and so we can deliver your documents when you have asked us to. Recovery-key use is restricted to the user-directed functions described in Section 3.3 of the Terms and, when legally required, compliance with valid and binding legal process under Section 3.5.

As a result:

a. ForeverVault staff do not view or browse your files;

b. You remain responsible for safeguarding your password and for keeping your nominated contacts accurate and current;

c. A Trusted Contact who signs in using the designated email address can access all current non-deleted Vault items, including items added later. Wallet contents are excluded. Users are responsible for selecting Trusted Contacts carefully and revoking access when appropriate. Anyone you nominate as a recipient will be able to read the User Content you designate for them, and you are responsible for choosing them carefully. An emergency contact receives only the message you configured, not your vault;

d. ForeverVault will disclose User Content only when required by applicable law or by legal process that ForeverVault reasonably determines to be valid, binding, and enforceable.

To the extent permitted by law, ForeverVault will notify you before disclosing your User Content so that you may seek appropriate legal relief. If ForeverVault is legally prohibited from providing prior notice, ForeverVault may provide notice after the prohibition expires, unless otherwise prohibited by law.

ForeverVault reserves the right, but does not undertake an obligation, to challenge or seek to narrow any request that it reasonably believes is unlawful, defective, or excessive. Any legally compelled disclosure will, where reasonably practicable, be limited to the User Content specifically required by the applicable legal process.

Except as authorized by you, required by applicable law, or expressly described in the Terms of Service or the Privacy Policy, ForeverVault will not disclose decrypted User Content to third parties. The full statement is in Section 3.5 of the Terms of Service.

3. LIMITATIONS OF THE SERVICE

To the maximum extent permitted by applicable law:

a. The Service is provided on an "AS IS" and "AS AVAILABLE" basis;

b. ForeverVault makes no warranties or representations, express or implied, regarding:

accuracy

completeness

availability

uptime

data retention

compatibility

legality of user-generated documents

suitability of documents for probate or estate administration

c. ForeverVault does not guarantee that:

files will be retained indefinitely;

legacy workflows will produce a desired outcome;

recipients, Trusted Contacts or authorized representatives will act lawfully or appropriately;

documents stored will be admissible in any court or jurisdiction.

Users assume all risks associated with their use of the Service.

4. NO RESPONSIBILITY FOR USER CONTENT OR ESTATE OUTCOMES

ForeverVault is not responsible for:

the accuracy, legality, or validity of documents uploaded by users;

the correctness of legacy instructions or their interpretation;

actions taken by heirs, executors, trusted contacts, or third parties;

the timing, delivery or effect of Legacy Shares or ForeverBinder reports;

disputes among family members, beneficiaries, or representatives;

any legal consequences arising from your estate distribution decisions.

You bear sole responsibility for ensuring that your estate planning documents comply with applicable law.

5. ForeverBinder Is an Organizational Report

ForeverBinder is a structured multipage report created from information entered by the user. It is not a will, trust, legal instrument, financial statement or substitute for professional advice. ForeverVault does not verify that the information is complete, current or legally sufficient. Creating or updating ForeverBinder does not automatically send or release it.

6. Free Forms and Attorney Directory

Free forms are general templates, are not state statutory forms and are not guaranteed to satisfy the law of any jurisdiction. A digital copy may not replace a signed original when an original is legally required. Users should consult an attorney regarding execution and suitability.

Find an Attorney is a directory, not a referral service or endorsement. Featured listings are paid placements and appear before other listings. ForeverVault does not evaluate or guarantee an attorney's qualifications, availability, advice or services.

7. Blockchain Proof Does Not Establish Legal Validity

Blockchain proof may show that the exact bytes of a document were timestamped, but it does not establish authorship, identity, signature validity, ownership, legal validity or that the document is the latest version. ForeverVault does not guarantee that a court or institution will accept it.

Current blockchain proofs hash the exact bytes of the document. Older proofs timestamp the vault record and are not a hash of the document bytes.

8. NO LIABILITY FOR INACTIVITY OR DEATH-RELATED ACTIONS

Inactivity may result in verification notices, account restrictions, notification to a Trusted Contact or eventual account closure as described in the Terms. Inactivity does not itself release a document, send ForeverBinder or establish that an account holder has died.

Legacy Share requires a designated recipient's sworn declaration, notice to the account holder and a three-calendar-day waiting period. It releases only the content designated by the account holder unless the release is stopped. Reporting a death does not provide an heir or other person with access to the entire vault.

9. THIRD-PARTY SERVICES AND LINKS

The Service may contain links or integrations with third-party tools, websites, or services.

ForeverVault does not endorse, control, or assume responsibility for third-party:

content

security practices

availability

reliability

accuracy

terms or policies

Your use of third-party services is at your sole risk.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ForeverVault and its affiliates, members, managers, employees, agents, and licensors shall not be liable for:

indirect, incidental, special, exemplary, punitive, or consequential damages;

lost profits, lost data, or loss of access to encrypted content;

damages arising from reliance on the Service or failure of legacy workflows;

unauthorized access to your account caused by your device, network, or actions of third parties;

disputes or claims arising from inheritance, estate transfers, or trusted contacts.

ForeverVault's total liability shall not exceed the greater of the amount paid to ForeverVault during the twelve months preceding the claim or one hundred U.S. dollars ($100).

11. CHANGES TO THIS DISCLAIMER

ForeverVault may update this Disclaimer from time to time. Material changes will be communicated through the Service, by email or by another reasonable method before they become effective.
